What are impact fees?

Municipalities assess impact fees on property developers to pay for infrastructure improvements that must be built due to new property development. New development brings new residents, which can put strain on a city's infrastructure and services, including schools, libraries, water and sewerage, police and fire protection services. Impact fees are designed to offset the additional cost of maintaining these services.

 

What do Impact Fees Cost?

This isn't a straight forward answer, as there are some variables to consider... Impact fees are based on Building Use, Location, Total Area and Fire District. See below for an Impact Fee Calculator Example based on a 2,000 Square Foot Single Family Home in Collier County.

Am I required to pay impact fees for a guest house?

Structures that the Building Department determine to be a guest house are treated as an addition to the single family home. There are two different tiers/rates for a single family home, depending upon the living area: 1) Less than 4,000 sq. ft.  2) 4,000 sq. ft. or more.  Impact fees are assessed when the new total living area square footage for both the guest house and home fall under a higher tier.  Please see the Residential Impact Fee Schedule on the impact fee schedule web page.  The impact fee web page also has an Impact Fee Calculator that will calculate the fee for you (choose Single Family Additions/Replacements), or contact the impact fee office at 252-2991 for a determination.

Am I required to pay impact fees for a residential detached garage or shed?

No, impact fees are not assessed on residential accessory structures.  Accessory structures are detached and include shed, garages, etc.

Am I required to pay impact fees if I convert my garage to a room?

When a garage is converted to a room, even if for storage, it is considered new living area under impact fee definitions.  There are two different tiers/rates for a single family home depending upon the living area: 1) Less 4,000 sq. ft. and 2) 4,000 sq. ft. or more.  Impact fees are assessed when a garage conversion causes the new living area square footage of the home to fall under a higher tier.  A Residential Impact Fee Schedule is available under Impact Fee Schedules and Forms, or the Impact Fee Calculator will calculate the fee for you (choose Single Family Additions/Replacements).

Am I required to pay impact fees if I enclose my lanai?

If the sliding glass doors are removed and/or air conditioning vents are added, the space is considered new living area for impact fee assessment.  There are two different tiers/rates for a single family home depending upon the living area: 1) Less 4,000 sq. ft.  2) 4,000 sq. ft. or more.  Impact fees are assessed when the new living area square footage for the lanai causes the total living area square footage of the home to fall under a higher tier.  Please see the Residential Impact Fee Schedule on the impact fee schedule web page.  The impact fee web page also has an Impact Fee Calculator that will calculate the fee for you (choose Single Family Additions/Replacements), or contact the impact fee office at 252-2991 for a determination.

Am I required to pay impact fees if there was a home previously on the property?

Impact fees will be charged for the difference between the amount of impact fees (at current rates) for the size of the previously existing home and the amount of the impact fees for the size of the new home.  The impact fee web page has an Impact Fee Calculator that will calculate the fee for you, or you can use the Residential Impact Fee Schedule also on the impact fee web page under Impact Fee Schedules and Forms.

Once a home is torn down, how long do I have to rebuild in order to retain the impact fee credit for the original home?

There is no time limit to rebuild.  Impact fee credit will be given for the previously existing home as long as acceptable documentation can be provided that shows the original home was legally permitted and that any impact fees due at that time (if any) were paid.

When are impact fees for a building permit required to be paid?

Impact fees for a building permit must be paid prior to issuance of a Certificate of Occupancy, except Fire Impact Fees, which are paid at issuance of the building permit.
